The school’s admission contract is, in many ways, a binding legal document.
For Schools: The incident was a public relations disaster. Even though DPS "won" legally (forced a settlement and expulsion), the scandal highlighted the institution’s cold, legalistic response to a mother’s emotional distress. Many fee-paying parents quietly withdrew their children, citing a "fear-based" atmosphere.
For the Legal System: The case exposed a gap in the RTE Act. While the act bans corporal punishment, it does not clearly define what happens when a parent accuses a teacher of it. Can a teacher tap a student’s palm with a belt? The court never decided. This ambiguity continues to plague Indian schools.
Part 3: The Legal Volley – Defamation Suit for ₹1 Crore
Realizing that the criminal case would drag on for years, the DPS management changed tactics. In a move that shocked legal experts, the school filed a civil defamation suit against Aparna Bedi, seeking damages of ₹1 crore (approximately $135,000 USD) . The suit argued:
- Loss of Reputation: Bedi’s media interviews and social media posts falsely portrayed DPS R.K. Puram as a "torture chamber" for children, causing irreparable harm to the brand’s 50-year legacy.
- Breach of Contract: By staging a protest instead of using the internal ombudsman, Bedi violated the Parent-School agreement signed at the time of admission.
- Malicious Intent: The school submitted internal CCTV footage showing Bedi using foul language against staff, contradicting her public image of a calm activist.
In her defense, Bedi’s lawyer argued that a school cannot sue a parent for defamation for complaining about student safety. He noted that the RTE Act overrides any school contract, and that raising a voice against corporal punishment is a fundamental right.
The Delhi High Court, however, allowed the defamation suit to proceed, observing that "the right to protest does not include the right to defame an institution without evidence."
