2. Why Is This Agreement Necessary?

In Indonesian civil procedure (PERMA No. 1 Tahun 2016 about Court-Mediation), mediators are entitled to a honorarium. However, for private (non-court) mediations, a written fee commitment agreement is strongly recommended.

Clause B: The "No Settlement, No Problem" Clause

This is the most contested clause. The mediator must be paid for time spent, regardless of outcome.
